In consideration of the services of Young and Brave, Inc. (doing business as The Young and Brave Foundation), I hereby agree, on behalf of myself and my agents, representatives, guardians, successors, children, heirs, assigns, next of kin, personal representatives, and estate (the “Related Parties”), to release, indemnify, and discharge Young and Brave, Inc., its agents, directors, officers, volunteers, participants, employees, independent contractors, and all other persons or entities acting in any capacity on its behalf (the “Releasees”), as follows:

1. EXCLUSION OF LIABILITY – I voluntarily release and agree not to hold the Releasees, nor any of them, liable for any damages or injuries I may suffer, whether to person or property, however caused, including the active or passive negligence of Young and Brave, Inc., breach of contract, and breach of any statutory duty or other duty of care, on the part of the Releasees, or any of them.

2. NO ACTION – I voluntarily agree not to bring any action, proceeding, or claims against the Releasees, or any of them, for any losses, damages or injuries that I may suffer, whether to person or property.

3. INDEMNITY – I voluntarily agree to indemnify and hold harmless the Releasees and each of them, from and against all claims, actions, cost, expenses and demands brought by any person in respect of death, injury, loss or damage, whether to person or property, resulting directly or indirectly from my participation with the Releasees and their projects and services.

I have read and understood this agreement and am aware that by signing this agreement I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators and assigns may have against the Releasees.

I understand and acknowledge that this release of liability applies to and includes all unknown or unsuspected consequences or results arising from or relating to my relationship with Young and Brave, Inc. I have read the contents of California Civil Code §1542, which says “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” I, for myself and the Related Parties, expressly waive any and all rights and benefits under California Civil Code §1542.
